Terms of use
Version 2, effective 22 October 2026
This is a translation provided for information only. The French version prevails.
Article 1: Who we are, and when these terms apply
Shopinata is a shopping list app published by Digression SAS (see the legal notice). These terms apply as soon as you tap "Let's go" or "Join" when you first open the app: doing so means you accept them. We record the version you accepted and the date. You can read these terms again at any time in Settings › About.
Article 2: The service
Depending on the app version and your country, Shopinata may offer:
- shopping lists and regular lists, shared with the members of a group (household, flatshare, family);
- a wallet for loyalty cards and gift cards, and quick access to the stores' apps;
- store search, opening hours and an "open now" indicator;
- your shopping history;
- store promotions, favourites (products, brands, stores) and notifications when a promotion concerns you;
- recipes and a product catalogue (information, images, suggestions), as well as recipes created by users, which they can share with their groups or suggest to Shopinata, and recipe ratings (article 4a);
- an optional profile (year of birth, gender, household make-up) to tailor suggestions and promotions;
- personalised offers and, where applicable, advertising (article 2a);
- optional paid features (article 2b);
- features being tested, reserved for testers (beta version, see the beta terms).
Some features are not available in every version: they may come later, be reserved for the beta or for certain countries. A feature that uses your data in a way the law makes subject to your agreement (personalised offers, personalised advertising, sharing aggregate figures…) is never switched on without a separate consent, asked in the app, never ticked in advance, and which you can withdraw at any time.
The core features (lists, sharing, cards, stores) are free.
Article 2a: Promotions, recipes, products and advertising
- Promotions and prices come from retailers, brands or their partners and are for information only. Only the price and conditions shown in store count. Shopinata sells nothing and is not a party to your purchases.
- Recipes and product information (ingredients, allergens, nutrition facts, images) come partly from open databases such as Open Food Facts and may be incomplete or wrong. Always check the product label, especially if you have an allergy or a medical diet.
- Recipes are ideas, not guarantees. You cook at your own risk: the result, times and temperatures depend on your equipment and your products. Read the warnings in each recipe (raw products, frying, storage, vulnerable people, children, allergies) and follow them. A recipe, whether it comes from us, from a partner or from another user, replaces neither a product label nor medical advice. To the extent permitted by law, Shopinata is not liable for the consequences of a recipe: a failed dish, food poisoning, an allergic reaction or a kitchen accident. This clause does not limit your consumer rights nor our liability for our own fault.
- Advertising and sponsored content: Shopinata may show promotions or content paid for by a retailer or brand. They are always labelled as such ("Sponsored") and say on whose behalf they are shown. By default they are not personalised. They are personalised only if you have agreed, and never for anyone under 18, nor based on sensitive information (health, pregnancy, religion, sex life).
- Alcohol: promotions and content about alcoholic drinks are reserved for people who have said they are 18 or older, and comply with French law (loi Evin). Alcohol abuse is dangerous for your health; drink responsibly.
- Aggregate figures: if you agree, Shopinata may share with retailers, brands or partners aggregate figures calculated over a minimum number of households, which never make it possible to identify a person or a household. Details are in the privacy policy.
Article 2b: Paid features
- Shopinata may offer paid features or plans (for example a subscription). They are optional: the core features stay free, and nothing becomes paid without your express agreement.
- They are covered by separate terms of sale, shown before any payment, with the price, duration and renewal.
- You have the rights provided by law: a 14-day right of withdrawal (unless you expressly ask to use the service straight away and waive that right), online cancellation in a few clicks, and information before each renewal.
- Payments made through the App Store or Google Play also follow those stores' rules (management and refunds from your Apple or Google account).
Article 3: Your account
- To get started, a first name (or a nickname) is enough: your account is created on this phone, with no email and no password.
- Without an email address, your account only exists on this phone. If you lose the phone, reset it or uninstall the app, we cannot give you back your lists or your cards: nothing lets us know that the account is yours. The lists in your shared groups stay with the other members.
- To avoid this, secure your account with your email address (a 6-digit code is enough, no password). You will then get everything back on a new phone. An email address is also needed to invite someone by email and for a share to become permanent (article 4).
- Anyone with access to your unlocked phone or to your mailbox can access your account: protect them.
- Optional profile: if you give your year of birth, gender or household make-up, you can change or erase them at any time in Settings › My account. Please answer the age question honestly: it protects minors (advertising, alcohol).
- Age: Shopinata is not intended for children under 13. Between 13 and the digital consent age of your country (15 in France, 13 to 16 elsewhere in the European Union), a parent's consent is required. A parent who invites their child into their group gives that consent and keeps an eye on how the child uses it.
- You can delete your account at any time in Settings › My account, or from shopinata.com/delete-account.
- Unused account: an account without an email address that has not connected for 12 months is deleted automatically, without notice, because we have no way to warn you. An account with an email address unused for 3 years is deleted after a notice email sent 30 days before.
Article 4: Shared groups
- The person who invites chooses whom they invite. Every member of a group sees and edits the lists of that group.
- You can invite someone with a link or a code (WhatsApp, text message…) or by email. The link or code opens the group to anyone who receives it, for 14 days: only send it to the person concerned. Whoever opens the link sees your first name and the name of the group.
- If one of you has not secured their account with an email address, the share is temporary for 10 days: the invited person sees and edits the lists, but not the shared loyalty cards. After that, access is paused without deleting anything. It comes back as soon as both your addresses are confirmed.
- When you invite someone by email, Shopinata writes to them on your behalf: only invite people who expect it.
- All members see the content of the group. A list can reveal personal information (diet, health, religion): only share a group with people you trust.
- When a member leaves the group or deletes their account, the lists stay with the other members. The last member to leave a group deletes it.
- When a member deletes their account, their items stay in the group and their first name becomes "Former member".
- Everyone is responsible for what they write. It is forbidden to post illegal, hateful or abusive content, or to use Shopinata to harass anyone.
Article 4a: Recipes you create, share or suggest
- You can create your own recipes, or import one from a link (in that case, only the title, ingredients, number of servings and the link to the original are kept).
- You choose who sees each of your recipes: only you, your close ones (the members of your groups) or everyone (after our review, see below). You can change this choice or remove the recipe at any time.
- Only share recipes you have the right to share: written by you, or with permission. Do not copy the text or photos of a book, a website or another app.
- Suggesting a recipe to Shopinata. You can also suggest one of your recipes so that it joins the Shopinata recipes. It must be yours. A recipe imported from a link cannot be suggested. You give your agreement by ticking three boxes when you suggest it: the recipe is yours or your family's, the photo of the dish (required) is yours, and you grant us the licence in article 10. Your own version stays in "My recipes", unchanged.
- Validation. Every suggested recipe is reviewed by our team, helped by our tools: nothing is published without this validation. To publish it, we may correct it, rewrite it, translate it, adapt its quantities and units, keep your photo or make a new one. We keep the spirit of your dish. A recipe we have rewritten carries the mention "adapted by Shopinata".
- We may refuse a suggested recipe, or remove it after it is published, at any time, at our sole discretion and without a detailed justification: the app only gives you a short reason. If you think this is a mistake, you can write to us through the contact form or at hello@shopinata.com: we review the suggestion again and reply to you.
- Your nickname and your avatar. When you suggest a recipe, you choose the nickname shown with it ("suggested by …"). The avatar you chose in the app (a drawing, never a photo) is shown next to it. This nickname and this avatar become public: in the app, on shopinata.com and in search engines. Choose your nickname accordingly (avoid your surname).
- Removing your name. At any time, in the app, you can choose to no longer be named on a published recipe. The app warns you before you confirm: this removal is final in the app. Your nickname and your avatar are removed everywhere, and the recipe stays published with the mention "suggested by a member". Your right to be recognised as the author never disappears: if you later want your name to be put back, write to us at hello@shopinata.com.
- A published recipe stays published if you remove your name or delete your account (article 10).
- Ratings. All recipes can be rated from 1 to 5 by users who have added them to a list: one rating per account, which can be changed. The average and the number of ratings are shown. Ratings are not verified. We do not change or delete them, except in case of abuse (abnormal votes detected automatically, illegal content). The rankings "most popular" (number of times added to lists) and "top rated" (an average that takes the number of ratings into account, with a minimum number of ratings) are calculated automatically.
- Shared or suggested recipes are subject to the content rules of article 4 and can be reported (article 8 bis). We may remove a recipe that does not comply (article 9).
Article 5: Loyalty cards
- Only add your own cards, or cards whose holder has allowed you to use them.
- It is forbidden to store bank cards, identity documents, health cards (such as health insurance cards) or any card revealing a political or religious opinion.
- The cards, their benefits and their conditions belong to the stores. Shopinata is neither a partner nor a representative of the stores.
- We do not guarantee that a displayed barcode will be accepted at the checkout: keep the store's app or card as a backup.
- Gift cards: you can note their amount, their expiry date and their secret code. If you share a gift card, the members of the group see this code and can use it: only share it with people you trust. We check neither the balance nor the validity of the card.
Article 6: Store information
Addresses, opening hours and store chains mainly come from OpenStreetMap, a free database maintained by volunteers. This information is given for guidance only: a store may be closed, have moved or changed its hours (public holidays, works). Check with the store before an important trip. You can report an error to us from the app or by email.
Article 7: Brands and logos
The names and logos of store chains and products belong to their owners. They are only used to recognise them; their presence does not mean that a store chain endorses Shopinata or works with us. A rights holder can ask for a logo to be removed at hello@shopinata.com: we remove it within 7 days.
Article 8: What we guarantee
- We do what is necessary for Shopinata to work properly and without data loss. Interruptions remain possible (maintenance, a provider's outage, no network): we keep them to a minimum and let you know when we can.
- Opening hours, addresses and store chains come from outside sources (article 6): they are for guidance only.
- Allergens flagged on recipes and the labels "halal compatible" or "kosher compatible" are deduced from the ingredients: they are for guidance only. They replace neither reading the label of the products you buy nor a certification. If you have a severe allergy, always check each product.
- What members of a group write is their own responsibility. As soon as we learn that content is illegal, we act quickly (article 8 bis).
- You benefit from the guarantees that the law gives consumers, in particular for digital content and services. Nothing in these terms reduces them.
Article 8 bis: Reporting content or behaviour
- In the app (group menu › "Report") or by email at hello@shopinata.com. This address is our single point of contact for users and authorities, within the meaning of articles 11 and 12 of the EU Digital Services Act (DSA). We answer in French and in English.
- Tell us what the problem is, where (group, list, item, recipe or member), why you think it is illegal, and your email address if you want an answer. We acknowledge receipt, then tell you what we have decided.
- A person reviews every report: no program decides for us. We cannot read the content of lists: we rely on what you send us (text, screenshot).
Article 9: Measures in case of abuse
- If an account does not comply with these terms (illegal content, harassment, unwanted invitations, harm to the service), we may, depending on the seriousness: warn, remove content, remove the person from a group, block invitations, suspend the account for a given period or delete it.
- We explain the decision (facts, rule concerned, duration) by email if the account has one, otherwise in the app, at the latest when the measure takes effect. The only exceptions: a ban by law or by an authority, or an immediate danger.
- You can challenge the decision for 6 months, by replying to the message or from the app. We review it again and answer within 15 days. You can also go to the mediator (article 12) or to court.
- If an account is deleted, the other members keep the lists of their groups. The cards this account was sharing disappear.
Article 10: Ownership of the app
The app, its code, its name, its logo, its visual identity and its illustrations (in particular the product and aisle pictograms created for Shopinata) belong to Digression SAS and are protected by copyright. You may use the app for personal use. Without our written consent, it is forbidden to:
- copy, extract, reproduce or reuse the pictograms, in whole or in part, including in modified form;
- decompile the app or bypass the protections of its files, except where the law allows it (interoperability);
- collect its content or data automatically (bots, scraping), or extract a substantial part of its databases (store chains, stores, products), which are protected by the database maker's right;
- resell or redistribute the app.
The pictograms carry an invisible marking that makes it possible to prove their origin. Some pictograms come from free libraries (Microsoft's Fluent Emoji, MIT licence): they remain subject to their licence, shown on the Credits page.
Your lists, and the recipes you keep to yourself or share with your groups, remain yours. You only allow us, free of charge and non-exclusively, to store them, sync them and show them to the members of your groups (a recipe may be shown to them automatically translated, marked "automatically translated"). This permission is worldwide, lasts as long as your account and, for the lists of a shared group, as long as that group exists. It is for that sole purpose. If you suggest a recipe to Shopinata (article 4a), you grant us, through the box ticked when you suggest it, a free, non-exclusive, worldwide permission for the full term of copyright to reproduce, correct, rewrite, translate, illustrate, adapt and publish it, in the app, on shopinata.com and on partner websites and apps that display Shopinata recipes (never in advertising), with your nickname and your avatar (or without them, if you remove your name). This permission is final for the version we publish: it does not end if you remove your name, delete your account or change your mind. What we create to publish it (corrected or rewritten text, new photo, translations) belongs to Digression SAS. You keep your rights in what you wrote and can go on using it as you wish. Any use of your data for other purposes is described in the privacy policy, and only happens with your consent where the law requires it.
Article 11: Changes
- We may change Shopinata and these terms for a valid reason: adding or improving features, complying with the law or a decision of an authority, fixing a mistake, improving security or fighting abuse.
- Non-substantial change (clarification, correction, new optional feature already listed in article 2, without taking anything away from you or costing you anything): we inform you in the app. No new acceptance is required.
- Substantial change to your disadvantage (a core feature removed, a new obligation, a free feature becoming paid): we let you know in the app, and by email if your account has one, at least 30 days in advance. If you do not agree, you can delete your account free of charge before that date and get your data back.
- New features that use your data in a way that requires your agreement are switched on by a separate consent in the app (article 2), never by changing these terms.
- The privacy policy is information: it evolves with the service, and we let you know of any important change.
Article 12: Disputes
These terms are governed by French law. If you disagree with us, first write to hello@shopinata.com.
- If our answer does not satisfy you, or if you get no answer within 2 months, you can use the consumer mediator free of charge: CM2C, 49 rue de Ponthieu, 75008 Paris, France, cm2c.net. You must first have written to us, and refer the matter to the mediator within one year of your complaint.
- If you are a consumer, you can go to the court where you live or the court of Digression SAS's registered office. If you are not a consumer, the competent courts are those of Digression SAS's registered office.
